INTRODUCTORY PROVISIONS
These Terms and Conditions (T&C) govern the use of the Services provided by YaTrader, including access to the Client Portal and Trading Platform.
By using the Services, you agree to these T&C. If you do not agree, you must not use the Services.
YaTrader reserves the right to modify these T&Cs at any time. You will be notified of any changes via the Client Portal or email.
DEFINITIONS
"Services" refer to all services provided by YaTrader, including the Client Portal and Trading Platform.
"Customer" or "You" refers to any individual or entity using the Services.
"Provider" or "YaTrader" refers to the company providing the Services.
ACCOUNT REGISTRATION AND USE
To access the Services, you must register an account with YaTrader.
You are responsible for maintaining the confidentiality of your account credentials.
You agree to provide accurate and complete information during registration and keep it up-to-date.
FEES AND PAYMENT
Fees for using the Services are outlined on the YaTrader website and may be subject to change.
Payments must be made using the methods specified on the YaTrader website.
Failure to pay fees may result in suspension or termination of your access to the Services.
LICENSE AND ACCESS
YaTrader grants you a limited, non-exclusive, non-transferable license to access and use the Services.
You agree not to misuse the Services or use them for unlawful purposes.
INTELLECTUAL PROPERTY
All intellectual property rights in the Services and Content provided by YaTrader remain the property of YaTrader or its licensors.
You may not use, reproduce, or distribute any Content from the Services without YaTrader's prior written consent.
DATA PROTECTION
YaTrader collects and processes personal data in accordance with its Privacy Policy.
By using the Services, you consent to such processing and warrant that all data provided by you is accurate
CUSTOMER OBLIGATIONS
You agree to comply with all applicable laws and regulations when using the Services.
You must not interfere with the proper functioning of the Services
THIRD PARTY SERVICES
The Services may include links to third-party websites or services. YaTrader is not responsible for the content or availability of these third-party services.
Your use of third-party services is at your own risk and subject to the terms and conditions of those services.
LIMITATION OF LIABILITY.
YaTrader's liability is limited to the maximum extent permitted by law.
YaTrader will not be liable for any indirect, incidental, special, punitive, or consequential damages.
In any event, YaTrader's liability will be limited to the amount you paid for the Services that caused the loss.
INDEMNIFICATION
You agree to indemnify and hold YaTrader harmless from any claims, damages, losses, or expenses arising out of your use of the Services.
TERMINATION
YaTrader may terminate or suspend your access to the Services at any time, without prior notice, for any reason, including violation of these T&Cs.
You may terminate your account at any time by contacting YaTrader support.
GOVERNING LAW AND DISPUTE RESOLUTION
These T&Cs are governed by the laws of the country we are based in.
Any disputes arising out of or in connection with these T&Cs will be settled by the courts of the governing country.
DISCLAIMER
You acknowledge that the Services and other Content are provided "as is" with all faults, and you assume full responsibility and risk for using them. YaTrader disclaims all legal, contractual, and implied warranties, including but not limited to warranties of quality, merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent allowed by law.
YaTrader will not be liable for any damages, including indirect, incidental, special, punitive, or consequential damages (such as lost profits, data loss, personal or property damage) arising from the use of the Services or reliance on any tools, functionalities, information, or other content available with the Services or on the Website. YaTrader is not responsible for third-party content, products, services, or applications that you may use in connection with the Services. Any liability of YaTrader established by a court or other competent authority will be limited to the amount paid by the Customer for the Services that caused the loss.
YaTrader reserves the right to modify, change, replace, add, or remove any elements and functions of the Services at any time without compensation.
YaTrader will not be liable for failure to deliver the purchased Services due to severe technical or operational issues beyond its control, crises, natural disasters, war, rebellion, pandemics, threats to large populations, or other force majeure events. Additionally, if YaTrader is unable to provide the Services due to legal obligations or directives from public authorities, it will not be held liable.
VIOLATION OF THE T&C
If you violate any provision of these T&C in a way that may cause harm to YaTrader, YaTrader may prevent you from ordering any additional Services and may restrict your access to all or some Services, including the Client Portal and Trading Platform, without prior notice and without compensation.
COMMUNICATION
You agree that all communication from YaTrader or its partners regarding the provision of Services will occur through the Client Portal or the email address you register with us. Written electronic communication via email or through the Client Portal is considered a written communication.
If you are a consumer, you have the right to withdraw from a
contract without giving a reason within 14 days of its
execution. PLEASE NOTE THAT IF YOU START PERFORMING DEMO TRADES
BEFORE THE EXPIRY OF THE SPECIFIED TIME LIMIT, YOU LOSE YOUR
RIGHT TO WITHDRAW FROM THE CONTRACT.
During the fourteen (14) days following your initial subscription to the Services, you may cancel and receive a fee refund if your account remains inactive, or if you have not placed any trade orders during this period.
To withdraw from the contract, you must send an email to
[email protected] within
the specified time limit. If you withdraw from the contract, we will refund all fees received from you without undue delay, no later than 14 days after your withdrawal. The refund will be processed in the same way you paid the fees.
YaTrader may immediately withdraw from the contract in the case of any breach by you as specified in Clause 15.
DEFECTIVE PERFORMANCES
If the Services do not match what was agreed or have not been provided to you, you can exercise your rights from defective performance. YaTrader does not provide any guarantee for the quality of the services. You must notify us of the defect without undue delay by sending an email to
[email protected] When exercising rights from defective performance, you may request that we remedy the defect or provide you with a reasonable discount. If the defect cannot be fixed, you have the option to either cancel the contract or request a reasonable discount, depending on the specific situation.
We will try to resolve any complaint you lodge as soon as possible (no later than within 30 calendar days) and will confirm its receipt and settlement to you in writing. If we fail to resolve the complaint promptly, you are entitled to cancel the contract.
CHANGES TO THE T&C
YaTrader may change the content of these T&Cs from time to time. The new T&C will prevail. You will be notified upon such changes taking effect via the Client Portal or via email. The YaTrader Evaluation and subsequent YaTrader Verification are provided throughout their duration pursuant to the version of the T&C valid and effective at the time the relevant YaTrader Evaluation was ordered.
COMPLAINTS
YaTrader takes your complaints seriously and will use its best endeavours to resolve your complaint as soon as possible.

We encourage you to get in touch as soon as an issue arises, but no later than 6 months after it occurs. We will acknowledge receipt of your complaint immediately or at the latest within 24 hours. Your complaint will be escalated to the relevant personnel. If your complaint remains unresolved after 10 days, we will:

CHOICE OF LAW AND JURISDICTION
Any legal relations established by these T&Cs or related to them, as well as any related non-contractual legal relations, shall be governed by the laws of the country we are based in. The Parties irrevocably agree that the courts shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with the T&C or its subject matter or formation (including non-contractual disputes or claims).
The provisions of clause 21.1 do not deprive consumers of the protection afforded to them by the mandatory laws of the relevant Member State of the European Union or any other jurisdiction.
FINAL PROVISIONS
These T&Cs constitute the entire agreement between you and YaTrader and supersede all prior agreements relating to the subject matter of the T&C, whether verbal or written.
Nothing in these T&Cs is intended to limit any legal claims set out elsewhere in these T&Cs or arising from the applicable law. If YaTrader or any third party authorized thereto does not enforce compliance with these T&Cs or delays exercising its rights under these T&Cs, this cannot be construed as a waiver of any right or claim.
YaTrader may assign any claim arising from these T&Cs or any agreement to a third party without your consent. You are not authorized to transfer or assign your rights and obligations under these T&C or any agreements, or any receivables arising from them, in whole or in part, to any third party.
Should any part, term, or provision of these T&Cs be declared invalid, void, or unenforceable, all remaining parts, terms, and provisions shall remain in full force and effect.
Prior to accepting these T&Cs, you have carefully assessed the possible risks arising from them and accepted those risks.
BEHAVIOR POLICY
YaTrader is dedicated to offering a fair and uniform service to all. We uphold the belief that everyone reaching out to us deserves to be listened to, understood, and respected. Our staff members are entitled to these rights as well, and we are responsible for providing them with a safe working environment. Additionally, we must guarantee the smooth and effective functioning of our business operations.
We may restrict access to our service where we consider someone’s actions or behaviour likely to have a negative effect on our staff or our work. This policy applies to all interactions or communications with us, including email, chat, and telephone.
All our staff have the right not to be subjected to aggressive, offensive, or abusive actions, language, or behaviour. This includes threats, physical violence, personal verbal abuse, derogatory remarks, and rudeness. Deliberately provocative or inflammatory statements and unsubstantiated allegations can also be considered abusive.
Unreasonable demands or persistence can impact our ability to review complaints or serve others. Examples include unreasonable response times, insistence on specific staff, frequent communication, changing complaints, or revisiting closed cases.
By using the Services provided by YaTrader, you agree to comply with these Terms and Conditions.
